1. General provisions
These terms and conditions govern the relationship between the operator of the Na dvou kolech project – nadvoukolech.cz:

(hereinafter “Na dvou kolech” or the “Operator”)
and the customer when ordering services offered through the nadvoukolech.cz website.
Services mean in particular the Adventure School, guiding and organisational services on motorcycle tours and other services listed on the website.
2. Registration and formation of the order
The customer registers via the form on the website or by individual agreement.
By submitting the application, the customer confirms interest in the selected date. A reservation is binding once it has been confirmed by the operator and the agreed price or deposit has been paid according to the instructions sent to the customer.
The specific scope of the service, date, price and information about what is and isn't included in the price are always stated with the specific event or in the order confirmation.
3. Adventure School
The Adventure School takes place on the dates and at the locations listed on the website.
The participant takes part in the training on their own motorcycle and is responsible for its technical condition. They are obliged to use appropriate protective equipment and to follow the instructors' organizational and safety instructions.
Training also takes place off paved roads and involves risks common to riding a motorcycle off-road. Every participant is obliged to adapt their riding to their abilities, experience, health condition and current conditions.
The Adventure School runs in all weather, as long as conditions allow it to be held safely. If necessary, the programme may be adjusted to current conditions.
4. Motorcycle tours
Na dvou kolech provides participants of motorcycle tours with a guiding and organizational service consisting mainly of route preparation, leading the group along that route and organizing the shared ride.
The price paid to Na dvou kolech is the price for this service.
Motorcycle transport is not part of this service or its price. The participant enters into a contract with the carrier separately and pays the transport price directly to the carrier.
The participant also arranges and pays at their own expense for accommodation, meals, fuel, ferries, flights, visas, insurance and other personal costs related to the trip, unless a specific tour explicitly states otherwise.
Na dvou kolech is responsible for the proper provision of its guiding and organizational service, not for services provided by third parties.
This is not a race or an organized sporting competition. The route may lead along paved roads, gravel, field, mountain and other unpaved tracks, and through sections off paved roads.
Every participant rides at their own risk and is solely responsible for controlling their motorcycle, choosing their speed and their riding style.
The participant acknowledges that riding a motorcycle, especially off paved roads, involves an increased risk of falls, injury, damage to the motorcycle and other losses.
Na dvou kolech is not liable for the consequences of an accident, a fall, health complications, illness, technical failure or damage to a motorcycle, loss of or damage to personal belongings, or other events, unless they were caused by a breach of obligations on the part of Na dvou kolech.
The guide sets the direction and organisation of the group ride, not the way each participant handles their motorcycle. Each participant is obliged to judge for themselves whether a given section matches their abilities, experience and current state of health.
If the guide assesses a particular section as unreasonably risky for a participant or the group, he may decide to change the route or recommend that the participant skip that section.
In case of serious or repeated disregard of safety or organisational instructions, dangerous riding or endangering other participants, a participant may be excluded from further group riding.
In the event of an accident, injury, technical failure or other emergency, Na dvou kolech will try to help the participant within its means. However, it does not provide medical, rescue, towing or assistance services and does not bear the costs associated with them.
5. Insurance
We strongly recommend that participants of foreign tours take out travel and accident insurance appropriate to the nature of the tour, covering motorcycle riding and, if possible, also riding off paved roads, the intervention of assistance or rescue services and any repatriation.
Checking the extent of insurance coverage is the responsibility of each participant.
Na dvou kolech is not responsible for the scope of insurance coverage arranged by the participant, nor for any refusal of an insurance payout by the insurer.
6. Cancellation policy – Adventure School
If a participant cannot attend the Adventure School, the following cancellation terms apply:
- more than 30 days before the start – 100 % of the amount paid refunded
- 14 to 30 days before the start – 50 % of the amount paid refunded
- less than 14 days before the start – the amount paid is non-refundable
After prior agreement, the participant may transfer their place to another person who meets the participation requirements. In that case, no cancellation fee is charged.
7. Cancellation policy – motorcycle tours
Given the long-term preparation of the tours and the limited number of places, the following cancellation terms apply:
- more than 60 days before the start – 100 % of the amount paid refunded
- 30 to 59 days before the start – 50 % of the amount paid refunded
- less than 30 days before the start – the amount paid is non-refundable
After prior agreement, the participant may transfer their place to another person who meets the participation requirements. In that case, no cancellation fee is charged.
These terms apply only to the amount paid to Na dvou kolech for guiding and organizational services.
Cancellation of services ordered and paid directly to other providers is governed by the terms of those providers.
8. Cancellation of the event by Na dvou kolech
If the Adventure School or another of our own services is cancelled by Na dvou kolech, the customer will be offered a replacement date or a refund of the price paid for the service not provided.
For motorcycle tours, this applies to the amount paid directly to Na dvou kolech for guiding and organizational services.
Na dvou kolech is not responsible for refunding amounts that the participant paid directly to other providers, for example a carrier, accommodation, airline, ferry operator or another supplier. Any cancellation of these services is governed by the terms of the respective provider.
9. Changes to the route, program or destination
The route and program of the tour are prepared in advance, but their exact course is not guaranteed.
The route, schedule or program may be changed before the start of the tour and during it, in particular due to weather, road conditions, closures, natural conditions, technical problems, decisions of local authorities, the security situation or other circumstances that could not reasonably be foreseen or influenced.
If serious circumstances arise that may affect the safety or feasibility of a tour in the planned country or region, Na dvou kolech may propose changing the destination of the tour altogether.
The reason may be, in particular, a war or the threat of one, a significant deterioration of the security or political situation, civil unrest, border closures, major restrictions on entry into the country, an epidemic or other serious health situation, a natural disaster or other extraordinary event.
In such a case, Na dvou kolech will try to offer an alternative destination and program that, as far as possible, matches the character and scope of the originally planned tour.
Participants will be informed of a change of destination without undue delay. If a participant does not agree to a material change of destination, further steps will be resolved according to the nature of the service ordered and the applicable legal regulations.
Changes to individual sections of the route during the tour due to weather, road conditions, safety or local conditions are a normal part of an adventure tour and are not in themselves considered a failure to provide the guiding service.
10. Participant's obligations
The participant is responsible for having a valid driving license, travel and other required documents, and a roadworthy motorcycle.
It is every participant's responsibility to check, before the trip, that their travel documents are valid, whether a visa is required, and any other entry conditions for each country.
The participant is obliged to comply with the laws of the country in which they are currently located.
Every participant is responsible for their own riding style and judges for themselves whether their skills, experience and current health allow them to continue riding safely.
11. Complaints and consumer dispute resolution
If the customer is not satisfied with the service provided, they may file a complaint with the operator using the contact details listed on the website.
The operator handles complaints in accordance with the applicable laws of the Czech Republic.
Consumers have the right to out-of-court resolution of consumer disputes.

12. Final provisions
These terms and conditions form part of the contractual relationship between the customer and the operator.
By submitting an order or application, the customer confirms that they had the opportunity to read these terms and conditions before ordering the service.
Legal relations not regulated by these terms and conditions are governed by the laws of the Czech Republic.
